Terms & Conditions & timelines of the EOI Process & Booking Process

1. The Applicant has applied for the allotment of a Plot by paying the booking amount after reading and understanding the terms and conditions of this Application. Subscribing to the Application by the Applicant/s amounts to deemed acceptance of all the terms and conditions specified herein.
2. The Application Form is only an Application by the Applicant/s towards purchase of an Plot at SLV Codename44 (Project) developed by SLV Infra Projects. (”Company”) and this Application (“Application”) to the Company shall not result in a confirmation/ concluded agreement between Company and Applicant/s in respect of the Plot at Project and that the entire transaction is subject to further execution of Sale Agreement (“Definitive Agreements”) between the Company and the Applicant/s as required under the applicable law. Shriram Properties Ltd shall act as the Marketing Partner of the Project. The Definitive Agreements shall provide, inter-alia, the total consideration payable by the Applicant/s for execution of sale deed and formation of the Plot and also provide the other terms and conditions including customary representations and warranties and commercial terms of the transaction between the Applicant/s and Company. The draft of the Definitive Agreements shall be as per the format and form as provided by the legal counsels of the Company.
3. The Applicant cannot claim any right or interest in the Plot merely by subscribing to the Application for allotment. The allotment of the Plot is subject to payment of the Booking Amount. It is entirely at the discretion of the Company and the Company reserves its rights at its sole discretion to either accept or reject any Application without assigning any reasons thereof. In case of rejection of the Application, the Company shall communicate in writing to the applicant about the rejection & refund the amounts received from the Applicant without any interest thereon. Unless rejected by the Company as described above, upon receipt/payment of the Booking Amount towards the selected Plot, the said Plot shall be deemed to be allotted to the applicant on the terms and conditions as stated in this Application Form.
4. The price as disclosed by the sales representatives of the Company is as per the signed pricelist / offer letter of the Plot in Project at the time of issue of the Application along with detailed cost break-up and charges including statutory deposits, maintenance, premium location charges, GST, levies, etc., for the Plot and shall be confirmed only upon acceptance and execution of Definitive Agreements between the Company and the Applicant/s. Additionally, the Applicant/s upon execution of Definitive Agreements, price being negotiated and settled therein, shall also be required to pay all the other charges, expenses and deposits, including, but not limited to infrastructure facilities like electricity, cable, telephone, internet connection, water and sanitary charges as provided in each of the Definitive Agreements. Few of the cost items shown and represented as a separate line item in the cost sheets may be included and represented as part of the basic cost while entering into Definitive agreements.
5. The details of amenities in the Project shall be provided in the Definitive Agreements. The Applicant/s undertakes and acknowledges that the Applicant/s is/are competent to enter into contract under the applicable laws and is / are not disabled under any law for the time being in force from entering into the transactions as contemplated herein. The Applicant/s declares and undertakes that the Applicant/s is / are not a blood relative i.e. parent, sibling, spouse and/or lineal descendant of any employee of the Company and/or its affiliates. In case of relationship, please provide the requested information in “The booking source authentication letter” which is part of the Application form.
6. It is agreed and acknowledged by the Applicant/s that prior to execution of Definitive Agreements there may arise situations when one or more Applicant/s may submit Application for the same Plot in Project. In such circumstances, the Company shall at its sole discretion, subject to availability, endeavor to make available to the Applicant/s with an alternate Plot of similar nature in the Project.
7. An amount of 9.9% of the Total Consideration Value is required to be paid by the Applicant/s to the Company as Booking Amount. On payment of the Booking Amount, and thereby allotment or finalization of Plot in the name of the Applicant, the Applicant shall be eligible to execute Definitive Agreements. The payment towards Booking Amount is required to be paid by way of Demand Draft / Crossed Cheque favoring/online SLV INFRA PROJECTS ESCROW ACCOUNT payable at Bengaluru. Until such time as payment of Booking Amount, the amounts collected as on date from the Applicant/s shall be treated as payments only as interest towards Plot.
8. At the time of booking, in addition to the Booking token the Applicant will be required to provide a Post Dated Cheque (PDC) for an amount equivalent to 9.9% ( less booking token ) of the plot cost to complete the Booking amount of 9.9% of the Plot chosen. This PDC should be dated within 15 days from the date of booking.
9. Applicant has to pay lifetime clubhouse membership charges through demand draft / online/cheque favouring “SLV PRIME CLUB”.
10. In case of delay in payment of booking amount by the Applicant/s, the Company reserves the right to either change the Plot pricing from offer price to the prevailing price or charge delay payment fees from the Applicant/s at the sole discretion of the Company.
11. Timely payments to be made by the Applicant/s in furtherance of this Application are the essence herein. Applicant/s shall not be entitled to substitute any other person for the Applicant/s for allotment of Plot house prior to execution of Definitive Agreements. Transfers, without a transfer fee, are allowed only amongst the family members like Father, Mother, Wife, Husband, Son and Daughter. In case of transfer/assignment of reservation to 3rd parties, it will be subject to company consent in writing and payment of appropriate transfer fee . The transfer/assignment shall allow only if the outstanding amount in Nill as on son date of seeking transfer/assignment.
12. Payment of consideration as provided in the Definitive Agreements and responsibility of raising of finances from third party banks / financing institutions, if required, shall be the sole liability and responsibility of the Applicant/s.
13. The dimensions and details provided in the accompanying literature are approximate and are subject to alteration without notice.
14. Further, the Applicant/s shall enter into a Definitive Agreement within THIRTY (30) days from the date of Booking, and the draft of the definite agreements shall be provided to the applicant prior to the same. The Applicant/s shall be provided either in hardcopy / softcopy of all legal and title documents pertaining to Project and the Company shall not provide for any further requisitions of documents other than clarifications on the legal and title documents already provided to the Applicant/s. Provided, the Applicant/s shall be required to complete legal and title due diligence within the aforesaid period of THIRTY (30) days and shall be deemed to have completed legal and title due diligence in respect of the Project on the lapse of the aforesaid THIRTY (30) days. Unless the duration for execution of the Definitive Agreements is extended, at its sole discretion, of the Company for further such period as it deems fit and such grace period is communicated by the Company to the Applicant/s in writing, failure to execute & register the Definitive Agreements with the Company within the aforesaid period of THIRTY (30) days and/or the grace period shall be deemed to be in default of the terms of the Application and liable to interest charges. In case of continued default, the company shall be entitled to, at its discretion, cancel the Application; and On and from the date of cancellation of the Application, the Company shall be entitled to re-allot the Plot to a third- party. The Company may at its sole discretion also restore the Application of the Applicant/s in respect of the Plot, subject to applicable charges and conditions as imposed by the Company.
15. The Applicant confirms and represents that he/she/they has/have made payment to the Company only towards the Plot and that he/she/ they shall not have any claim of any kind whatsoever in any other development undertaken by the Company within the Project.
16. The Applicant has seen and accepted the plans, design and specifications and the Applicant authorizes the Company to effect suitable and necessary alterations/modifications in the layout plan, designs and specifications as the company may deem fit or as may be directed by any competent authority(s).
17. GST / Service charges and all other charges, levies and payment for the individual Plot in relation to this transaction will be borne and paid by the Applicant/s.
18. Upon execution of the Definitive Agreements, the stamp duty, registration charges, legal expenses and all other applicable expenses for execution of Definitive Agreements and Sale Deed in pursuance of Definitive Agreements shall be paid by Applicant/s as per the rules prevailing at the time of registration.
19. All requests/communication/commitments to the Promoter should be made in writing and shall be addressed to cobt@shriramproperties.com with the subject line including details of Apartment number and name of Project as provided in the Application.
20. Notice for cancellation from the Company will be dispatched under certificate of posting or register post to the address indicated on the Application and acknowledgment for dispatch is a sufficient proof for forthwith cancellation thereof.
21. Cancellation Charges: In the event of any cancellation and/or termination and/or withdrawal of Application by the Applicant/s for any reason whatsoever, the following cancellation charges will be applicable:
    • Post Plot Selection but before Agreement: Entire amount paid as on cancellation date would be forfeited, upto max of 9.9% of Plot cost.
    • Post Agreement: The terms and conditions of the Agreement would be final and binding.
    • The Cancellation Charges shall be considered as a genuine pre-estimate of damages likely to be suffered by the Company including loss of opportunity costs and shall be treated as liquidated damages.
22. The Cancellation Charges shall be deducted from the amounts paid by Applicant/s to the Company. Upon accepting a request for cancellation, the Company is entitled to forthwith re-allot and re-sell the Plot to any other third-party and on such terms and conditions as the Company deems fit.
23. Errors and Omissions Excepted (E&OE).
